- Why does registration take so long?
- The process includes examination, publication in the Trade Marks Journal, and a statutory opposition window during which third parties may object. Your rights date from filing, not from the certificate, so early filing matters.
- What is a trademark class?
- Goods and services are divided into classes under the Nice Classification. Protection only extends to the classes you register, which is why class selection deserves real thought.
- Should I register the name, the logo, or both?
- A wordmark protects the name in any styling and is usually the stronger asset. A device mark protects the specific logo. Many businesses file both.
- Someone is already using my brand name. Can I still register?
- Possibly, depending on whether they have registered it and how long they have used it. A search will tell us where you stand before you commit.
